In 2018, derived from a citizen complaint, the organization Los Superc\u00edvicos documented that the pharmaceutical chain Farmacias del Ahorro had a systematic practice at the national level that consisted of felling trees with the aim of building parking spaces at the entrance of its branches, it was recorded that more than 1,809 trees had been felled nationwide. For this reason, Los Superc\u00edvicos, together with TOJIL and MCCI, denounced the felling of 103 trees in the Mexico City branches and a possible corruption scheme of this modus operandi before the Mexico City Attorney General’s Office.<\/p>\n\n\n\n

In this case we achieved a historic resolution that recognizes us as a victim during the criminal proceedings against the pharmaceutical company, for which reason we now collaborate hand in hand with the CDMX General Prosecutor’s Office in clarifying the facts and their investigation, to ensure that This is not another case of impunity.<\/p>\n\n\n\n

The organizations requested to have the status of victim to be able to participate and collaborate with the Public Ministry in the investigation, however, the CDMX General Prosecutor’s Office refused to recognize this status. Therefore, they went to a public hearing before a control judge to combat this determination. In it, the judge agreed with the organizations and revoked the determination of the prosecutors and ordered that they be recognized as victims, especially for the crime of felling trees.<\/p>\n\n\n\n

Based on this, the organizations are collaborating in the investigation and providing evidence that has turned out to be key pieces for the process. In the investigations it was discovered that Farmacias del Ahorro could be acting in collaboration with another company to fell the trees, which has the same representatives and managers.<\/p>\n\n\n\n

Currently the case is still ongoing before a federal court that must rule on the prescription or not of the crimes committed by the pharmaceutical company. If a ruling against Farmacias del Ahorro is achieved, one of the first precedents at the national level would be generated in which a company is charged with criminal responsibility for an environmental crime, which, in addition, would be obliged to repair the damage to society and , on the other hand, would prevent these behaviors from continuing to be perpetuated.<\/p>\n\n\n\n

In a country where 99% of reported crimes go unpunished, it is most likely that an accusation of this type, against a powerful company like Farmacias del Ahorro, would have been dismissed through bribery. However, citizen participation has allowed a completely different story to be told.<\/p>\n\n\n\n

En 2018, derivado de una denuncia ciudadana, la organizaci\u00f3n Los Superc\u00edvicos document\u00f3 que la cadena farmac\u00e9utica Farmacias del Ahorro ten\u00eda una pr\u00e1ctica sistem\u00e1tica a nivel nacional que consist\u00eda en derribar \u00e1rboles con el objetivo de construir cajones de estacionamiento en la entrada de sus sucursales, se registr\u00f3 que a nivel nacional se hab\u00edan derribado m\u00e1s de mil 809 \u00e1rboles . Por ello, Los Superc\u00edvicos junto con TOJIL y MCCI denunciaron el derribo de 103 \u00e1rboles en las sucursales de la Ciudad de M\u00e9xico y un posible esquema de corrupci\u00f3n de este modus operandi ante la Fiscal\u00eda General de la Ciudad de M\u00e9xico.<\/p>\n\n\n\n

En este caso logramos una hist\u00f3rica resoluci\u00f3n que nos reconoce como v\u00edctima durante el procedimiento penal en contra de la farmac\u00e9utica, por lo que ahora colaboramos mano a mano con la Fiscal\u00eda General de la CDMX en el esclarecimiento de los hechos y su investigaci\u00f3n, para lograr que este no sea un caso m\u00e1s de impunidad.<\/p>\n\n\n\n

Las organizaciones solicitaron tener el car\u00e1cter de v\u00edctima para poder participar y colaborar con el Ministerio P\u00fablico en la investigaci\u00f3n, no obstante, la Fiscal\u00eda General de la CDMX se neg\u00f3 a reconocerles este car\u00e1cter. Por ello, acudieron a una audiencia p\u00fablica ante un juez de control para combatir esta determinaci\u00f3n. En ella, el juez concedi\u00f3 la raz\u00f3n a las organizaciones y revoc\u00f3 la determinaci\u00f3n de los fiscales y orden\u00f3 que estas fueran reconocidas como v\u00edctimas, especialmente por el delito de derribo de \u00e1rboles.<\/p>\n\n\n\n

A partir de ello las organizaciones est\u00e1n colaborando en la investigaci\u00f3n y aportando evidencias que han resultado ser piezas clave para el proceso. En las indagaciones se descubri\u00f3 que Farmacias del Ahorro podr\u00eda estar actuando en colaboraci\u00f3n con otra empresa para el derribo de los \u00e1rboles, la cual cuenta con los mismos representantes y directivos.<\/p>\n\n\n\n

Actualmente el caso sigue en curso ante un juzgado federal que debe pronunciarse respecto a la prescripci\u00f3n o no de los delitos cometidos por la farmac\u00e9utica. De lograrse una sentencia contra Farmacias del Ahorro, se generar\u00eda uno de los primeros precedentes a nivel nacional en el que se le imputa responsabilidad penal a una empresa por un delito ambiental, la cual, adem\u00e1s, estar\u00eda obligada a reparar el da\u00f1o a la sociedad y, por otro lado, evitar\u00eda que estas conductas se sigan perpetuando.<\/p>\n\n\n\n

En un pa\u00eds en donde el 99% de los delitos que se denuncian quedan impunes, lo m\u00e1s probable es que una acusaci\u00f3n de este tipo, en contra de una empresa poderosa como Farmacias del Ahorro, se hubiera desestimado a trav\u00e9s de sobornos. Sin embargo, la participaci\u00f3n ciudadana ha permitido contar una historia completamente diferente.<\/p>\n\n\n\n
